The Collaborative Process, a client-centered approach to divorce, began
when a long-time divorce attorney in Minnesota became increasingly
dissatisfied with the outcomes of the adversarial nature of litigation and by
the reaction of his clients to the litigation process.  Believing that most
people really didn’t want to go to court to solve their problems but had no
other way to deal with their conflict, he created a conflict-resolution
approach that is gaining popularity with families who are committed to work
openly and honestly together in order to minimize the negative effects of
divorce on the family.

So what exactly is a Collaborative Divorce?  Sometimes called Collaborative
Law or Collaborative Practice, it’s a non-adversarial approach in which the
couples themselves, not strangers with law degrees, decide amicably on an
outcome that’s fair and just to everyone involved.  Both parties and their
attorneys make binding commitments that they will not go to court to settle
disagreements.  With a commitment to openness and honesty, parties use
creative problem-solving and a team of trained professionals to come up
with the right solutions for their family.  

Because the parties themselves are making decisions using a win-win
approach, research shows that the Collaborative Process produces better
results for children, greater satisfaction of the parties, and a decreased
likelihood that there will be future legal problems.  Research suggests that
the Collaborative Approach is much less stressful and emotionally draining
than the traditional divorce process.  It’s also generally less costly and time-
consuming than having a trial.
